LEGAL SCENARIO

Sam Farmer ran the stop sign and hit Joe Derby’s horse trailer wherein he hurt the two horses that were inside. Sam panicked and left the scene of the accident because his driver’s license was expired. Deputy Gleason arrived to Mr. Farmer’s house and arrested him.

1) Can Mr. Farmer be cited for running a stop sign if he says that a large oak branch was covering it completely?

2) What can Mr. Derby recover from Mr. Farmer if both his horses can no longer work on the farm?

3) Can the State Attorney’s Office file criminal charges against Mr. Farmer for leaving the scene of a car accident that caused personal injuries to Mr. Derby and also to both horses?
